This Privacy Policy explains how FD Multimedia ("we", "us", "our") collects, uses, shares, and protects personal data when you use Multigen AI, our website, our mobile apps, and the live chat / AI assistant widget embedded on our site (collectively, the "Services"). We process personal data in accordance with Brazil's General Data Protection Law (LGPD — Lei nº 13.709/2018) and other applicable regulations.

• Provide the Services — operate your account, run AI generations and 3D configurations (including sending your uploads to third-party AI providers to fulfil your requests), and maintain your generation history.
• Manage billing — administer your subscription, plan, and credit balance.
• Support & live chat — respond to your questions through our AI assistant or human agents; if a request needs human follow-up and none is available, we may create a support ticket and email your request (including your name, email, and message) to our support team so a human can respond.
• Communicate with you — send account, billing, and service-related notices. We may also send product updates or marketing messages if you have not opted out; every marketing message includes an unsubscribe option. Service-related notices are not affected by that opt-out.
• Security & fraud prevention — detect abuse, protect accounts, and enforce these Terms and rate limits.
• Legal compliance — meet tax, accounting, and other legal obligations.
• Improve the Services — analyze aggregated, de-identified usage patterns to improve features and reliability. We do not use your uploaded or generated content to train our own AI models.

3. Legal Basis for Processing (LGPD)

Under Article 7 of the LGPD, we process your personal data on one or more of the following bases: (a) performance of a contract with you (account administration, billing, delivering the Services); (b) our legitimate interests in operating, securing, and improving the Services, balanced against your rights and expectations; (c) compliance with a legal obligation (such as tax and accounting records); and (d) your consent, where required — for example, for optional marketing communications, which you may withdraw at any time.

4. AI Processing & Third-Party Providers

To generate images, videos, and 3D content, your uploads and prompts are transmitted to third-party AI infrastructure providers that process this data solely as our processors, strictly to fulfil your request. We do not use your content to train our own AI models, and we contractually restrict these providers from using your content beyond what is necessary to deliver the Service to you.

5. Data Sharing & Disclosure

We do not sell your personal data. We share it only with:

• Infrastructure & AI providers necessary to operate the Services (hosting, storage, AI generation).
• Payment processors to process your subscription.
• Email delivery providers to send account, billing, and support-related notifications, including support-ticket emails triggered from the live chat widget.
• Authorities, when required by law, court order, or to protect our rights, users, or the public.
• A successor entity, in the event of a merger, acquisition, or asset sale — subject to the same protections described in this Policy.

6. International Data Transfers

Our infrastructure and some of our AI and service providers operate outside Brazil. Where personal data is transferred internationally, we rely on contractual and technical safeguards consistent with the LGPD to protect it, regardless of where it is processed.

7. Storage & Security

Your data is stored on Cloudflare's global infrastructure (including object storage and databases), protected by encryption in transit and at rest. Access to production systems is restricted to authorized personnel on a need-to-know basis. No system is perfectly secure, and we cannot guarantee absolute security, but we maintain reasonable technical and organizational measures appropriate to the sensitivity of the data involved.

8. Data Retention

We retain your personal data while your account is active and for as long as needed to provide the Services, resolve disputes, and comply with legal obligations. You can delete uploaded content and generated outputs at any time from the app. When you delete your account, we remove associated personal data from active systems within a reasonable period (typically within 90 days), except:

• Billing and invoicing records, which we retain for up to five (5) years to comply with Brazilian tax and accounting law;
• Data we must retain longer to comply with a legal obligation, resolve a dispute, or enforce our agreements.

9. Your Rights Under the LGPD

As a data subject under the LGPD, you have the right to:

• Confirm whether we process your personal data, and access it;
• Correct incomplete, inaccurate, or outdated data;
• Anonymize, block, or delete unnecessary, excessive, or unlawfully processed data;
• Port your data to another provider, subject to trade-secret and intellectual-property protections;
• Obtain information about the public and private entities with whom we have shared your data;
• Revoke consent at any time, where processing is based on consent, without affecting the lawfulness of prior processing;
• Object to processing carried out on the basis of legitimate interest;
• Request review of decisions made solely by automated processing that affect your interests.

10. Children's Privacy

The Services are not directed to individuals under 18. We do not knowingly collect personal data from minors. If you believe a minor has provided us personal data, contact us and we will take reasonable steps to delete it.

11. Cookies

We use strictly necessary cookies and similar local-storage technologies to keep you signed in, remember your preferences, and protect the Services against abuse. We do not use third-party advertising or cross-site tracking cookies on the Services.

We may update this Policy from time to time to reflect changes to the Services or legal requirements. We will update the "Last updated" date above and, for material changes, make reasonable efforts to notify you (such as by email or an in-app notice) before they take effect.
